First of all, the facts incriminated concern only the illegal deportation and transfer of Ukrainian children, in violation of Articles 8-2-a-vii and 8-2-a-viii of the Rome Statute: Putin is not , at this stage, not indicted for war crimes committed by Russia in Ukraine. Then, the evidence provided by the Prosecutor seems sufficiently solid to engage the criminal responsibility of Putin and Lvova-Belova. Regarding the incriminated acts, Articles 8-2-a-vii and 8-2-a-viii of the Statute qualify as war crimes "the illegal deportation or transfer or illegal detention" and "the taking of hostages".
  
This is an offense initially provided for in Article 49 of the 1949 Geneva Convention relative to the Protection of Civilian Persons in Time of War. In Ukraine, according to certain NGOs such as Amnesty International , thousands of children have been victims of illegal deportation and transfer to Russia. Moreover, during the war, presidential decrees were signed by Vladimir Putin to speed up the granting of Russian citizenship to these children “thus facilitating [their] adoption by Russian families”. These facts would prove “the intention to permanently remove these children from their own country”. Regarding individual criminal responsibilities, Vladimir Putin is suspected as the perpetrator of these crimes (Article 25-3-a of the Statute) and as a hierarchical superior (Article 28-b).
